I am requesting copies of all documents, manuals, written instructions, or policies that give direction to management staff  for the issuance of discipline to Port employees.  This is a public records request and consistent with the rights guaranteed by the Meyers Milias Brown Act.

Dear Ms. Cleveland:

 

We have released all of the requested documents.  As mentioned in our previous messages to you, all documents responsive to your request were released to you last month except for the fully executed MOUs for Local 21, SEIU, and IBEW.  These MOUs have just become available and have been released to you, and accordingly, complete our response to your California Public Records Act request.  Thank you.

 

Request for Cure & Correction: We hope this response is satisfactory to you.  If you believe the Port has failed to comply with the Public Records Act, you may submit a written Request for Cure and Correction to the Secretary of the Board.  This Request must be filed within 90 days of the alleged noncompliance.  The Office of the Port Attorney will investigate all Requests and respond within 30 days.  For further information, please refer to the "Frequently Asked Questions" section on the Port's Public Records webpage.

Dan, I submitted a Freedom of Information Request for any and all written policies issued to management for issuing discipline. This would not be something listed in a MOU. This may be included in training materials to managers or memos issued by Human Resources. I received the reply below stating that the department was waiting for copies of MOUs. The materials I’m requesting ,if they exist would not be listed in any MOU. Could you please direct the legal department to respond accordingly. The Port is currently in violation of the FOIA. Dear Ms. Cleveland - We've released the requested documents.  The only remaining items are the fully executed MOUs for Local 21, SEIU, and IBEW.  We are awaiting fully executed copies of those documents and will release them as soon as they become available.  We are extending the due date in the meantime and will keep you updated.  Thank you.
