Request #19-1
  Closed

I would like to request video footage of a traffic accident I was involved in at  the Oakland Airport on 12/12/2018 between the time 5:54 am and 6:05 am.  I have already spoke to Will Kuna at Airport Security (510-563-6544), he stated that he was able to obtain some footage and was going to archive it.  I was driving a Blue 2016  Ford Fiesta licence # 7YFW519, and pulled in to the area after the taxi cab parking but before the South West Entrance of terminal #2.  I was struck by a black 2004  Honda Accord with the license plate number  6NMV111.  Will Kuna did explain that the license plate numbers might not show up as there is a lot of glare from head lights. The following link is a Google map showing the approximate location (https://www.google.com/maps/@37.7121994,-122.2124404,3a,75y,217.05h,93.1t/data=!3m6!1e1!3m4!1sYe6FzgKL8axsLFrn5q429w!2e0!7i16384!8i8192).

I'm interested in seeing the footage of me entering and of the driver that I was in the accident with, entering their car and leaving.

Thank You for your help.

Dear Mr. Harig:

We have located and retained the requested video footage.  Unfortunately, however, we cannot release the footage under the Public Records Act because the video depicts how the Port protects the terminal frontage from potential criminal and terrorist attacks, and may also depict the nature and frequency of security patrols, and therefore the public interest in withholding such critical information outweighs the public interest in disclosing it.  (Gov. Code § 6255(a).)

The footage will be retained for at least one year.  Thank you again for your request.

Request for Cure & Correction: We hope this response is satisfactory to you.  If you believe the Port has failed to comply with the Public Records Act, you may submit a written Request for Cure and Correction to the Secretary of the Board.  This Request must be filed within 90 days of the alleged noncompliance.  The Office of the Port Attorney will investigate all Requests and respond within 30 days.  For further information, please refer to the "Frequently Asked Questions" section on the Port's Public Records webpage.
