Under the California Public Records Act § 6250 et seq., I am requesting an opportunity to inspect or obtain copies of public records that pertain to all building and construction permits, hardship exemptions and all correspondence relating thereto, for the business called the Waterfront Hotel located at 10 Washington Street, Oakland, CA, as far back as such records are maintained, but no further than January 1, 1970. The California Public Records Act requires a response within ten business days. If access to the records I am requesting will take longer, please contact me with information about when I might expect copies or the ability to inspect the requested records. If you deny any or all of this request, please cite each specific exemption you feel justifies the refusal to release the information and notify me of the appeal procedures available to me under the law. Request for Cure & Correction: We hope this response is satisfactory to you.  If you believe the Port has failed to comply with the Public Records Act, you may submit a written Request for Cure and Correction to the Secretary of the Board.  This Request must be filed within 90 days of the alleged noncompliance.  The Office of the Port Attorney will investigate all Requests and respond within 30 days.  For further information, please refer to the "Frequently Asked Questions" section on the Port's Public Records webpage.

Thank you for the message.  We'll await the check and will scan and release the records as soon as we receive the check.  We've also extended the due date in the meantime.

 

On a separate note, we located some plans and related correspondence relating to the expansion of the Waterfront Hotel (previously called the Boatel) that appear relevant to your request.  These were already in electronic form and we just released them with no charge.

Dear Ms. O'Donohoe: We've located a number of Port building permits relating to the Waterfront Hotel dating approximately 1988-2000.  The files are only in hard copy, however.

You are welcome to review them on-site at the Port's offices at 530 Water Street, Oakland at a mutually convenient time.  Alternatively, we can provide scanned copies but charge $0.19/page.  Please let us know how you'd like to proceed.  We'll extend the due date in the meantime.  Thank you.

Dear Ms. O'Donohoe: As discussed on our call yesterday, we do not have any permits or associated documents since approximately 2000 when the Port no longer had permitting authority over this property.  The City of Oakland may have the documentation you need.  We will continue to search for potentially responsive documents from 1970-2000 that we may have.  We are extending the due date in the meantime while we continue our search.  Thank you.
