Dear Ms. Russo:


The Port had received two submissions in response to its Request for Qualifications for the Aviation Environmental Planning (CEQA and NEPA) Consulting Services at Oakland International Airport.  However, it has not yet made a selection and therefore there are no winning proposals to release.  Furthermore, any submissions relating to this RFQ cannot be released prior to the Port’s final selection because the public interest in not disclosing bid documents outweighs the public interest in their disclosure at this point in time, before a proposer had been selected by the Board and a contract negotiated.  (Gov. Code § 6255; Michaelis, Montanari & Johnson v. Superior Court (2006) 38 Cal.4th 1065.)


The Port anticipates making a final selection by late summer 2019, at which time you may submit another request for records.  Thank you again for your request.


Request for Cure & Correction: We hope this response is satisfactory to you.  If you believe the Port has failed to comply with the Public Records Act, you may submit a written Request for Cure and Correction to the Secretary of the Board.  This Request must be filed within 90 days of the alleged noncompliance.  The Office of the Port Attorney will investigate all Requests and respond within 30 days.  For further information, please refer to the "Frequently Asked Questions" section on the Port's Public Records webpage.
