I'm adding onto a record request by David Wooley -- I see that the final report on the electrical supply infrastructure for cargo handing equipment and vehicles won't be complete until mid-July, however can the draft report be shared, in the interim, with a confidentiality agreement until the final is released? Thanks.

Dear Ms. Chen:

 

Per our recent conversations, we will not be able to share the draft report since the public interest in protecting the decision-making process while the Port and its consultant deliberate candidly as to the scope and findings of the report clearly outweighs the public interest in disclosing them, especially since the final report is slated to be released in response to another public records request.  (Gov. Code § 6255; Times Mirror Co. v. Superior Court (1991) 53 Cal.3d 1325, 1339-44.)  The final report, to the extent it is non-privileged, should be released in response to Request No. 19-64 by Mr. Wooley.

Request for Cure & Correction: We hope this response is satisfactory to you.  If you believe the Port has failed to comply with the Public Records Act, you may submit a written Request for Cure and Correction to the Secretary of the Board.  This Request must be filed within 90 days of the alleged noncompliance.  The Office of the Port Attorney will investigate all Requests and respond within 30 days.  For further information, please refer to the "Frequently Asked Questions" section on the Port's Public Records webpage.
